Terms and Conditions

I. General Provisions

All ticket sales, whether concluded online or otherwise, are governed by these Terms and Conditions. Recording (video, photography, or audio) is not permitted during concerts.

1. Ticket Sales / Delivery / Shipping

1.1. Online Sales

Payment for tickets ordered via the web shop may be made by PayPal, credit card (Visa, Mastercard) using the 3-D Secure process, or direct debit (IBAN). Tickets are dispatched by post for a fee, delivered immediately via the Ticketdirect process, or held at the box office.

For Ticketdirect purchases, tickets are transmitted electronically to the buyer as a downloadable PDF. Saving and printing for legitimate personal use is permitted. Passing on a ticket to family members, friends, or as a gift is allowed. Copying, altering, commercially reselling, or misusing the PDF file is not permitted. If a ticket is presented more than once, only the holder of the first valid scan will be admitted.

1.2. Orders by Email

Email orders become binding only upon receipt of payment following invoicing. Tickets must be paid in full by the specified date. Tickets not paid on time may be resold. Please direct enquiries to info@concerts-dresden.com.

1.3. Dispatch

Tickets may be sent by post on request for a flat fee of € 4.90 regardless of the number of tickets. Ticketdirect delivery or collection at the box office is free of charge. Delivery or binding reservation is subject to receipt of the full amount.

Statutory rules apply to dispatch and the risk of delivery. Dispatch requires a correct address.

2. Venue and Admission

Venue: Wallpavillon at the Dresden Zwinger, Theaterplatz, 01067 Dresden.

Business address of the organiser: Malinovsky Events GmbH & Co. KG, Theaterstraße 6, 01067 Dresden.

Admission times at the Wallpavillon: For regular concerts at 5:00 pm, doors open at 4:00 pm. For children’s concerts at 2:00 pm, doors open at 1:30 pm. For evening concerts at 7:30 pm, doors open at 7:00 pm. The box office is located inside the concert hall and closes when the performance begins. For guest performances, please refer to the individual event listing.

3. Ticket Returns

Duly delivered tickets are non-returnable and non-exchangeable as a matter of principle. There is no entitlement to a refund or replacement ticket in the event of personal inability to attend, late arrival, or non-attendance. The organiser is not responsible for the customer’s travel to or from the venue. Events beyond the organiser’s control (e.g. strikes, weather) do not entitle the customer to return tickets. Statutory rights in the event of cancellation or disruption by the organiser remain unaffected (see §6).

Wallpavillon at the Dresden Zwinger – voluntary goodwill arrangement (no legal entitlement): In justified individual cases, a voluntary rebooking to another concert may be offered up to 4 working days before the event date. A rebooking fee of € 5.00 per ticket applies. Reboookings of arrangements (e.g. “Konzert & Dinner”) are only possible up to 4 working days before the event. This goodwill arrangement applies solely to tickets booked directly with Malinovsky Events GmbH & Co. KG / DRESDNER RESIDENZ KONZERTE. The customer’s statutory rights remain unaffected.

For tickets purchased through an authorised ticket outlet, please contact that outlet in the first instance. The customer’s statutory rights, particularly in the event of cancellation or other disruption, remain unaffected regardless of the point of purchase.

Ticket insurance (voluntary): Taking out ticket insurance is voluntary and is not part of the booking. Insurance is available through our partner ERGO during the booking process.

4. Complaints

Upon receipt of tickets, customers are asked to check the delivery immediately for accuracy and to notify us promptly of any discrepancies. Please contact us without delay at info@concerts-dresden.com if ordered tickets do not arrive within ten working days of the full payment being made. Statutory rights are not affected by a failure to notify or delayed notification.

5. Lost Tickets

In the event of a lost ticket, we will check whether the purchased ticket can be identified using the order confirmation, booking number, or customer details. If successfully verified, a replacement ticket may be issued for a processing fee of € 5.00 per ticket. For events with unreserved seating, issuing a replacement ticket may not always be possible. 6. Postponements, Cancellations and Changes

Events may be moved to different dates or venues for good reason, in particular if artists are unwell.

In the event of cancellation, the customer’s statutory refund rights apply. A refund in the form of a voucher is only provided with the customer’s consent. In the event of a change of date, venue, programme or cast, the customer’s statutory rights remain unaffected. Statutory claims for reimbursement of fees or compensation for further losses are not excluded by these Terms.

7. Concessions

Malinovsky Events GmbH & Co. KG / DRESDNER RESIDENZ KONZERTE may offer concessions to eligible groups at guest performance venues against presentation of valid proof. Discounted tickets are valid only with such proof and are non-transferable. Retrospective concessions are not available.

Wallpavillon at the Dresden Zwinger: For regular concerts at the Wallpavillon, children under 12 years of age are entitled to the children's price shown in the ticket shop. The age on the day of the event is decisive. From the 12th birthday, the regular price applies. No further personal concessions are offered. For children's concerts and arrangements, the separately stated prices apply. Tickets already purchased retain their validity under the conditions at the time of booking.

8. Vouchers

Vouchers are available as monetary gift vouchers and as event- or category-specific vouchers (e.g. for a particular ticket category or an arrangement such as “Konzert & Dinner”). The type of voucher is stated in the booking confirmation.

Monetary gift vouchers may be redeemed against concert tickets and arrangements offered by Malinovsky Events GmbH & Co. KG / DRESDNER RESIDENZ KONZERTE. If the ticket price exceeds the voucher value, the difference is payable. For questions about remaining balances, please contact info@concerts-dresden.com.

Event- or category-specific vouchers may be redeemed for the stated purpose. An additional payment may be required for price increases or special events; the euro value of the voucher will not be reduced as a result.

Vouchers are valid for three years from the end of the year of issue (statutory limitation period) and may be redeemed subject to availability. Cash redemption is excluded unless required by law. Extension of validity is not possible. Third-party vouchers cannot be redeemed. For redemption enquiries, please contact info@concerts-dresden.com.

Existing entitlements arising from vouchers already issued remain unaffected.

9. House Rules

Smoking is prohibited during events in accordance with applicable non-smoking legislation.

Pushchairs may not be brought into the concert hall for safety reasons. For regular concerts, we recommend checking the suitability for the age of your child in advance. For children’s concerts, the age guidance given in the individual event listing applies.

Wallpavillon at the Dresden Zwinger: Access to the concert hall and toilets is via stairs; step-free access cannot be guaranteed. Please contact us before booking if you have any questions about accessibility: info@concerts-dresden.com or +49(0)351–41886230.

Legally recognised assistance dogs are permitted in accordance with applicable law. We kindly ask you to notify us in advance at info@concerts-dresden.com so that we can arrange a suitable place.

Bicycles and uncontrolled animals are not permitted.

10. Liability

Malinovsky Events GmbH & Co. KG / DRESDNER RESIDENZ KONZERTE is liable without limitation, in accordance with statutory provisions, for damages arising from injury to life, limb or health, and for breaches of material contractual obligations. Liability for other damages caused by simple negligence is excluded. Liability for gross negligence and intent remains unaffected.

11. Data Protection

Malinovsky Events GmbH & Co. KG / DRESDNER RESIDENZ KONZERTE processes personal data for the performance of the contractual relationship and in accordance with applicable data protection law.

12. Right of Withdrawal

For contracts for concert visits and other leisure events with a specific date or period, there is generally no statutory right of withdrawal pursuant to § 312g para. 2 no. 9 of the German Civil Code (BGB). Statutory rights in the event of cancellation, disruption or other breach of duty remain unaffected. This exclusion does not apply categorically to undated monetary gift vouchers or goods; the relevant statutory withdrawal rules apply in those cases.

13. Jurisdiction / Place of Performance

The statutory provisions apply to jurisdiction and place of performance.

14. Toilets

Wallpavillon at the Dresden Zwinger: The toilets for concert visitors are located on a different level from the concert hall and are accessible by stairs only (no step-free access).

II. Severability Clause

Should any individual provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected.
