1) Personal Data
Personal data is individual information relating to a person or that is suitable for establishing a reference to a person, such as their name, postal address, telephone number, email address, bank details, etc. Personal data can therefore be used to draw conclusions about a person's identity.
2) Collection, Processing and Use of Personal Data
In principle, it is not necessary for you to disclose personal data in order to use the above-mentioned websites. If you provide personal data, you always do so voluntarily. In certain cases, your name, address and, where applicable, further personal information are required if you wish to use, order and/or purchase the services and goods offered on the websites, some of which are subject to a charge, so that Malinovsky Events GmbH & Co. KG or its respective cooperation partners can provide, deliver and process the desired/ordered services and goods. These include, for example: purchasing tickets, items and vouchers; subscribing to the newsletter; access to areas requiring registration/login; participation in prize draws; services and goods offered by cooperation partners of Malinovsky Events GmbH & Co. KG or other third parties via the above-mentioned websites, where Malinovsky Events GmbH & Co. KG merely brokers the resulting contract between provider and user.
3) Services
For services that require the provision of personal data, you will be explicitly informed of the data required. The data collected in this context is treated as strictly confidential by Malinovsky Events GmbH & Co. KG or its cooperation partners and is used solely in connection with the purpose for which you provided the data.
Your personal data will only be processed and used for other purposes if you, as a user, have expressly consented to this or if processing and use is legally permitted even without consent. Your express consent is required, for example, if Malinovsky Events GmbH & Co. KG wishes to use your telephone and/or email data for advertising and marketing purposes (e.g. to inform you about interesting offers and new products). You may withdraw your consent at any time with immediate effect vis-à-vis Malinovsky Events GmbH & Co. KG. If necessary, write to the postal or email address of Malinovsky Events GmbH & Co. KG given in the legal notice.
The relevant statutory provisions, in particular the Federal Data Protection Act, the Saxon Data Protection Act and the Telemedia Act, are observed in the collection, processing and use of data.
4) Disclosure of Data to Third Parties
Your personal data provided on the above-mentioned websites is, in principle, not passed on to third parties. Your data is only transmitted to third parties if you have expressly consented to this disclosure, if the transmission is necessary for the use, performance and/or processing (delivery, payment processing, etc.) of the services, goods and offerings you have used, ordered and/or purchased (e.g. to subcontractors, agents, cooperation partners and/or other third parties), if there is a legal, judicial or official obligation to do so, or if it is necessary to prevent misuse of the services offered.
5) Use of Cookies
This website uses so-called session-related cookies. A cookie is a small text file that your web browser stores, together with the data actually requested from the internet, in your temporary internet cache, so that all user functions across the entire offering of a provider can be implemented. The cookie expires at the end of the browser session. If you visit the website again, a new cookie is created. If you disable cookies in your web browser, you will generally still be able to use the offerings of this website without restrictions.
6) Purchase of Tickets / Admission Tickets
Malinovsky Events GmbH & Co. KG uses the data you provide to fulfil and process the contract for the purchase of admission tickets. In this context, Malinovsky Events GmbH & Co. KG uses the data to inform you, among other things, about the booked performance, any changes to the programme, or directions. If Malinovsky Events GmbH & Co. KG has received your address or email address in connection with the purchase of an admission ticket, Malinovsky Events GmbH & Co. KG may also use this data for direct advertising for other performances by Malinovsky Events GmbH & Co. KG, unless you have objected to this use. Such an objection is possible at any time and may be addressed to: Malinovsky Events GmbH & Co. KG, DRESDNER RESIDENZ KONZERTE, Schützengasse 3, 01067 Dresden, Germany, tel. +49 351 41 88 62 30, email: tickets@concerts-dresden.com. Upon complete deletion of your customer account in the ticketing system of Malinovsky Events GmbH & Co. KG, your data will be blocked from further use and deleted after expiry of the applicable tax and commercial retention periods, unless you have expressly consented to further use of your data. Pursuant to §§ 247 AO, 257 HGB (German tax and commercial code), accounting records must be retained for ten years and business correspondence for six years. Upon registering for the newsletter, your email address is used exclusively for our own advertising purposes until you unsubscribe from the newsletter. You may unsubscribe at any time.
7) Ticket Shops
In principle, users can visit the above-mentioned websites and ticket shops without leaving any personal data. However, use of all functions of the connected ticket shops is only possible after the user has registered. To do so, the user must provide their name, address, telephone number and email address. Malinovsky Events GmbH & Co. KG, as operator of the webshops, processes the user's personal data in compliance with the data protection provisions applicable to the contract. The data is collected, processed and used by it in an automated procedure to the extent necessary for the establishment, structuring or modification of the contractual relationship. Malinovsky Events GmbH & Co. KG uses the telephone number to contact you by phone should problems arise in connection with payment processing (e.g. late payment to Malinovsky Events GmbH & Co. KG, direct debit reversal, incorrect bank details). Malinovsky Events GmbH & Co. KG is entitled to transmit this data to third parties commissioned by it to perform the contract, to the extent necessary to fulfil the contracts concluded. Otherwise, Malinovsky Events GmbH & Co. KG does not pass on user data to third parties unless the user has given express consent to do so or it is a purchase on account (see item 6 above). The user may withdraw their consent at any time without giving reasons vis-à-vis Malinovsky Events GmbH & Co. KG.
Shortly before the event for which the user has purchased a ticket, Malinovsky Events GmbH & Co. KG may send the user further information about this event by email (e.g. directions and parking options). Following the respective event, Malinovsky Events GmbH & Co. KG may ask the user by email for a review of the event; participation in this survey is of course voluntary. The information referred to under item 1) above is processed for these services.
The information obtained in connection with the ticket purchase is also used to (1) send the user the newsletter, (2) inform the user in future when the same or similar events to the one for which the user purchased a ticket take place, and (3) remind existing customers and newsletter subscribers by email of an incomplete order if the ordering process was abandoned, unless the user has objected to this. Non-customers only receive the newsletter if they have registered for it. At the user's request, Malinovsky Events GmbH & Co. KG will notify the user by email as soon as new event dates become available for the concerts selected by the user. Note: the user may object to the use of data for these purposes at any time, e.g. in their customer account, in writing, or by email to newsletter@concerts-dresden.com, at no cost other than the transmission costs at basic rates. Users who have actively registered for the newsletter may unsubscribe from the newsletter at any time, with effect for the future, via the channels named above.
8) The user may query and change the data stored for the purpose of using Malinovsky Events GmbH & Co. KG's services at any time via their user account. If the user's data is to be permanently deleted, a corresponding notification to Malinovsky Events GmbH & Co. KG is sufficient. Please note that, under certain circumstances, certain personal data may only be deleted after a certain period of time due to statutory or contractual retention obligations. In this case, the affected data will be blocked until deletion.
9) To make the ticket shop as convenient as possible for the user, so-called cookies are used. Cookies are small text files that are stored on the user's hard drive. Cookies are used for the shopping cart function and to compile statistics on the use of the ticket shop, in order to continuously improve the offering for the user. Malinovsky Events GmbH & Co. KG does not use any technologies that combine information generated by cookies with user data in order to determine the user's identity. The ticket shop can generally also be used without cookies, although this may result in limited functionality of the ticket shop. Web browsers can be set so that cookies are accepted or rejected generally or on a case-by-case basis.
Malinovsky Events GmbH & Co. KG uses your IP address to the extent necessary for the technical provision of the website. In addition, Malinovsky Events GmbH & Co. KG stores your IP address for security reasons for a maximum period of seven working days, in order to ensure the stability and operational security of the IT systems used and to prevent or trace their misuse.
10) Within the offering of this ticket shop there may be links to the pages of other providers. As Malinovsky Events GmbH & Co. KG has no influence on these websites, users are advised to check any information on data protection provided there. Malinovsky Events GmbH & Co. KG assumes no responsibility for the content of linked pages.
11) The ticket shop uses so-called social plug-ins of the social network facebook.com. The operator of the network is Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). When a page of the ticket shop containing a social plug-in (e.g. the Like button) is accessed, the user's browser establishes a connection to Facebook's servers, and the content required for the social plug-in is loaded, provided the user has previously clicked the "activate social media" button. Facebook receives the web address of the ticket shop accessed by the user, the date and time of the visit, and the user's IP address. If the user is logged into Facebook at the same time, Facebook can associate the visit with the user's Facebook account. If the user clicks the Like button in the ticket shop, this information is also transmitted to and stored by Facebook. Even if the user of the ticket shop is not a Facebook member, it is still possible that Facebook may obtain and store the corresponding IP address, provided the user clicks the "activate social media" button. Malinovsky Events GmbH & Co. KG has no influence on the content of the plug-ins or the transmission of information to Facebook. The purpose and scope of data collection and the further processing and use of data by Facebook, as well as the rights and settings available to protect users' privacy in this respect, can be found in Facebook's privacy policy (available at http://www.facebook.com/policy.php).
12) This website uses Google Analytics, a web analytics service provided by Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043, USA ("Google"). Google Analytics uses so-called "cookies", text files that are stored on the user's computer and that enable an analysis of the use of the website. The information generated by the cookie about the use of the website is usually transmitted to and stored on a Google server in the USA.
The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data. Malinovsky Events GmbH & Co. KG has additionally extended Google Analytics on this website with the code "anonymizeIP". This ensures the masking of the user's IP address so that all data is collected anonymously. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.
On behalf of Malinovsky Events GmbH & Co. KG, Google will use this information to evaluate use of the website, compile reports on website activity, and provide other services relating to website and internet usage to the website operator. Users may prevent the storage of cookies by adjusting their browser software accordingly; in this case, it may not be possible to use all functions of this website in full.
Users may also prevent Google from collecting the data generated by the cookie and relating to their use of the website (including their IP address), and from processing this data, by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en. An opt-out cookie will then be set, preventing future collection of the user's data when visiting this website. The opt-out cookie applies only in this browser and only for this website, and is stored on the user's device. If the user deletes the cookies in this browser, the opt-out cookie must be set again.
Malinovsky Events GmbH & Co. KG also uses Google Analytics to evaluate data from DoubleClick cookies and AdWords for statistical purposes. If a user does not wish this, it can be disabled via the Ads Settings manager (https://www.google.de/settings/ads/).
13) In order to avoid misunderstandings and disruptions in payment transactions, Malinovsky Events GmbH & Co. KG reserves the right, in the case of SEPA direct debit payment, to evaluate information on past payment behaviour at the ticket shops operated by Malinovsky Events GmbH & Co. KG, and to obtain creditworthiness information based on mathematical-statistical methods from SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden, Germany. It is further noted that, for the purpose of deciding on the establishment, performance or termination of contractual relationships as part of risk management, probability values for the user's future behaviour may in individual cases be collected or used, and that address data may also be used to calculate these probability values.
